LOCALIZA LOYALTY PROGRAM

REGULATIONS

The LOCALIZA LOYALTY PROGRAM ("PROGRAM"), developed by LOCALIZA RENT A CAR S.A. ("LOCALIZA"), CNPJ/MF: 16.670.085/0001-55, has the purpose of encouraging car rental at LOCALIZA and will be exclusively governed by the clauses and conditions of these regulations ("REGULATIONS").

 

1. PROGRAM MEMBERSHIP

1.1 Any individual who rents a car from LOCALIZA can take part in the PROGRAM ("PARTICIPANTS"), in accordance with these REGULATIONS.

1.2 If the client is a corporation, the driver/user of the rented car may, in the capacity of individual, become a PARTICIPANT of the PROGRAM.

1.3 Only one membership per client is permitted.

1.4 By joining the PROGRAM, the PARTICIPANT accepts all rules and conditions established in these REGULATIONS and becomes responsible for its acknowledgement and compliance, as well as for the information provided to LOCALIZA, with the obligation of keeping their registry data always updated.

1.5 For the purposes of demonstrating the validity of the PARTICIPANT'S acceptance and expression of intent, LOCALIZA may store logs of their acceptance upon registration.

1.6 Cancellation of membership or change in registry data may only be carried out by the PARTICIPANT by telephone, at 0800 979 2020.

 

2. MODALITY OF LOYALTY CARDS

2.1. There are three modalities of the LOCALIZA LOYALTY CARD ("CARD"), which will be made available to PARTICIPANTS according to the number of points earned in the PROGRAM.

(i) GREEN CARD: a VIRTUAL card issued upon entrance in the PROGRAM, regardless of the number of LOYALTY POINTS.

(ii) GOLD CARD: a PHYSICAL card issued upon earning at least 3,000 LOYALTY POINTS in twelve (12) consecutive months.

(iii) PLATINUM CARD: a PHYSICAL card issued upon earning at least 5,000 LOYALTY POINTS in twelve (12) consecutive months.

 

3. POINTS

3.1 The awarding of points ("POINTS") will follow the classification below:

(i) LOYALTY POINTS: awarded to each Car Rental Agreement in proportion to the car rental value.

(ii) BONUS POINTS: added to Loyalty Points according to the category of the CARD.

(iii) PROMOTIONAL POINTS: awarded in promotional actions of LOCALIZA, with the eligibility and value defined in accordance with the respective promotion.

3.2 For the purposes of earning LOYALTY POINTS, only the amounts related to car rental will be considered, such as: daily rental fees, pickup/return fees at Downtown and Airport Branch Offices, insurance and additional items contracted.

3.3 Exceptions: For the purposes of earning LOYALTY POINTS, amounts that are not exclusively related to the car rental, such as, for example, traffic tickets, indemnities, expenses refund and operating costs, will not be considered.

3.4 To change the CARD category, only LOYALTY POINTS earned will be considered.

3.5 The determination of the volume of points to downgrade the CARD category will take place annually, always on March 31, according to the number of points earned in the 12 months prior to the date established in this clause.

3.6 The downgrading of CARD category will always be to the category immediately below the current one.

3.7 POINTS will be credited through payment of the respective bill of the Car Rental Agreement and will be available for consultation within 5 business days .

3.8 There will be no POINTS for the following contracts:

(i) Monthly rental

(ii) Not fully paid

(iii) With booking placed through an insurance company or broker

(iv) Executed as swap

(v) Referring to the replacement of cars of Localiza Gestão de Frotas

(vi) Administrative agreements arising from bidding/waiver/unenforceability, or signed with Public Officials on the post

(vii) Signed as courtesy

(viii) Signed by companies operating as car or fleet rental companies

(ix) Expressly determining that no POINTS will be accrued

(x) Signed by a PARTICIPANT with pending rental payments with LOCALIZA or with a negative credit report.

3.9 PARTICIPANTS with more than 3,000 points earned can transfer them to another PARTICIPANT by submitting a request to fidelidade@localiza.com.

3.10 The points may be blocked if the Participant has payments pending with Localiza and may be cancelled in case of negative credit report.

 

4. USE OF POINTS

4.1 The request for redemption of points can only be made by the PARTICIPANT, while picking up or returning the car, upon signing the Car Rental Agreement / Insurance Proposal at the Localiza Branch Office.

4.2 Points earned can only be used for payment of daily rental fees, and cannot be used for payment of extra or additional rental items.

4.3 Points earned may be used for full or partial payment of the Car Rental Agreement, but cannot be used for payment of daily rental fee fractions.

4.4 To redeem their points, PARTICIPANTS must check the conversion table available at www.localiza.com/fidelidade.

4.5 Upon using the points, any points credited until that date will be considered for the purposes of deduction.

4.6 The points credited can be used on any date and at any branch office of LOCALIZA, depending on fleet availability.

4.7 Points can be used within 24 months after the respective date of credit, always observing the order of maturity, and are not renewable.

 

5. OTHER BENEFITS

PARTICIPANTS of the PROGRAM have additional benefits, according to the CARD category in the redemption period.

5.1 Choice of car model:

PARTICIPANTS holding GOLD or PLATINUM CARDS will be entitled to choose the car model from a restricted group, via Express Check-in and Localiza Express, depending on availability at the Branch Office of pickup.

5.2 Express Check-in

PARTICIPANTS holding GOLD or PLATINUM CARDS can view their Car Rental Agreement/Insurance Proposal directly on their mobile phones. After doing this, when arriving at a LOCALIZA branch office, the PARTICIPANT only needs to show their driver's license and sign the Agreement.

(i) PARTICIPANTS must have booked the car to have access to their Agreement via Express Check-in.

(ii) Express Check-in can be done within 2 hours before car pickup.

(iii) LOCALIZA guarantees the booking for 2 hours after Express Check-in.

(iv) It is a pre-requisite for using Express Check-in that the PARTICIPANT inform as payment method a valid credit card previously registered with LOCALIZA.

(v) Express Check-in is subject to branch office availability.

5.3 Localiza Express:

PARTICIPANTS holding GOLD or PLATINUM CARDS can view their Car Rental Agreement/Insurance Proposal on self-service totems ("LOCALIZA EXPRESS") at the LOCALIZA branch office. After doing this, the PARTICIPANT only needs to sign the Agreement.

(i) PARTICIPANTS must have booked the car to have access to their Agreement via LOCALIZA EXPRESS.

(ii) It is a pre-requisite for using LOCALIZA EXPRESS that the PARTICIPANT inform as payment method a valid credit card previously registered with LOCALIZA.

(iii) LOCALIZA EXPRESS will be available at the branch offices listed in Annex II .

5.4 Express Service:

PARTICIPANTS holding PLATINUM CARDS will be entitled to preferred service ("EXPRESS SERVICE").

(i) Legal preferences shall prevail over the preferences established in these REGULATIONS.

(ii) EXPRESS SERVICE will be available at the branch offices listed in Annex II of these REGULATIONS.

5.5 Loyalty Upgrade:

PARTICIPANTS holding GOLD or PLATINUM CARDS will be entitled to an upgrade of the car group requested, in the case of daily rental agreements.

(i) PARTICIPANTS holding PLATINUM CARDS will be entitled to 3 upgrades valid for 12 months as from the date of entrance in the category.

(ii) PARTICIPANTS holding GOLD CARDS will be entitled to 1 upgrade valid for 12 months as from the date of entrance in the category.

(iii) The upgrade benefit depends on availability at the branch office.

(iv) PARTICIPANTS will receive credit to use the benefit when they reach the GOLD or PLATINUM CARD status.

(v) The benefit will be renewed every 12 months, if the PARTICIPANT maintains the status of their GOLD or PLATINUM card.

(vi) Use of the benefit is valid for as long as the PARTICIPANT maintains the status of their GOLD or PLATINUM card.

5.6 Extra time for car return:

PARTICIPANTS holding the GOLD or PLATINUM CARD will be entitled to extra time of 2 hours to return the car with no extra time charges.

(i) This benefit is not valid for agreements with corporate clients and individuals renting through Travel Agencies and Insurance Companies.

(ii) Extra time of more than 2 hours will result in charges in full amount for all extra hours.

(iii) This benefit does not apply to Extension Fee agreements.

5.7 Additional Driver

PARTICIPANTS holding GOLD or PLATINUM CARDS will be entitled to include in their daily rental agreement an additional driver without charge.

(i) This benefit is not valid for monthly rental agreements with corporate clients and individuals renting through Travel Agencies and Insurance Companies.

(ii) This benefit does not apply to Extension Fee agreements.

5.8 Exclusive Shuttles:

PARTICIPANTS holding PLATINUM CARDS who rent cars from the "F Group" or any higher category will be entitled to exclusive shuttle between the branch office and the airport terminal, in their own rented car, from 6 a.m. to 10 p.m.

(i) The benefit is subject to driver availability at the car return branch office.

(ii) Exclusive Shuttle will be available at the branch offices listed in Annex III of these REGULATIONS.

 

6. GENERAL CONDITIONS

6.1 The table for converting points into daily rental fees ("TABLE") and other promotions carried out by LOCALIZA will be periodically published on the website www.localiza.com/fidelidade.

6.2 During the validity of the TABLE, special points may be awarded for limited duration.

6.3 LOCALIZA reserves the right to change the parameters for converting points into daily rental fees, upon prior and express publication on the website www.localiza.com/fidelidade.

6.4 It is expressly forbidden for PARTICIPANTS to carry out any act of commercialization of the benefits, advantages or premiums obtained through this PROGRAM. Proof of any such conduct will lead to immediate removal of the PARTICIPANT from the PROGRAM and cancellation of their POINTS, without prejudice to the applicable legal measures.

6.5 LOCALIZA reserves the right to remove the client from the PROGRAM and cancel their POINTS upon learning of any conduct proven to be irregular, with or without intent, adopted by the PARTICIPANT when using or obtaining benefits from the PROGRAM, with the possibility of forbidding their return to the PROGRAM.

6.6 None of the PARTIES is accountable for non-compliance with any condition as a result of events caused by acts of God and/or force majeure.

6.7 Clarifications about the PROGRAM are available at www.localiza.com/fidelidade or by telephone at 0800 979 2020.

6.8 The occurrence of any other act or fact not envisaged in these Regulations will be decided upon irrevocably by Localiza.

 

7. VALIDITY AND TERM OF THE PROGRAM

7.1. The PROGRAM is regulated in accordance with the laws of Brazil and is valid in Brazil and countries where LOCALIZA has branch offices.

7.2. The PROGRAM is valid for an undetermined period and may be amended, at LOCALIZA's discretion, upon prior notice.

7.3 LOCALIZA may cancel or change the conditions of the PROGRAM, as well as make any amendments to these REGULATIONS, at any time and upon prior communication to the PARTICIPANTS, guaranteeing the right to redeem points earned within no more than 180 days after the date of the notice.

7.4 Participants of the program in force before these REGULATIONS take effect will be automatically added to this PROGRAM and the points earned until that moment will be maintained.

 

8. FINAL PROVISIONS

8.1. These REGULATIONS are registered at the Notary's Office for Deeds and Other Documents of the city of Belo Horizonte/MG, under number 1194159, replacing and cancelling any previous regulations, regardless of them being registered or not.

8.2 The parties elect the High Court of Belo Horizonte, Minas Gerais, to settle any disputes, to the exclusion of any other courts, however privileged.
